By accessing or using DiamantSEO ("the Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service. The Service is operated by Diamant Marketing, based in Malmö, Sweden.

DiamantSEO is an automated, AI-powered SEO platform developed by Diamant Marketing. The Service generates SEO-optimized blog posts using large language models, performs automated keyword research targeting high-intent, low-competition queries, and publishes content directly to your website or content management system. Key features include: (a) AI blog post generation with SEO scoring, meta descriptions, schema markup, and structured headings; (b) automated daily publishing to supported platforms including WordPress, Shopify, Wix, Webflow, Ghost, GoHighLevel, Notion, Joomla, Drupal, and custom sites via webhook; (c) an internal backlinking network that automatically creates contextual links between your posts and, when opted in, cross-site links with partner content; (d) a real-time analytics dashboard tracking views, clicks, conversions, SEO scores, and AI visibility metrics; (e) support for content generation in 26 languages. The Service connects to your website or CMS via APIs or credentials you provide, and publishes AI-generated content on your behalf, subject to your subscription plan and configured settings.

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for safeguarding your password and for any activity or actions taken under your account. You agree to notify us immediately of any breach of security or unauthorized use of your account. We reserve the right to disable any account at any time in our sole discretion.

The Service is offered via a paid subscription plan (DiamantSEO Pro) at $59.00 per month. When you subscribe, a 14-day free trial begins - your payment method is authorized but you are not charged for 14 days. If you cancel before the trial ends, you will not be charged at all. This is a free trial, not a money-back guarantee. Trial Cancellation Is Your Responsibility. You are solely responsible for canceling your free trial before it expires if you do not wish to be charged. We are not liable for charges incurred because you forgot or failed to cancel before the trial end date. We may send trial-expiration reminders as a courtesy, but we are not obligated to do so, and the absence of any reminder does not relieve you of responsibility for canceling. If you do not cancel before the trial ends, your payment method will be automatically charged the monthly subscription fee, and such charges are non-refundable. After the trial period ends, your card will be charged the monthly subscription fee. Once a payment is charged, you have access to the Service for the remainder of that billing month. Fees are billed in advance on a recurring monthly basis. By subscribing, you authorize us to charge the applicable subscription fees to your designated payment method. No Refunds After Payment. There is no money-back guarantee after the free trial ends. Once you have been charged (whether after the trial or on any subsequent billing date), all paid subscription fees are non-refundable, including if you change your mind after payment, cancel mid-billing period, or stop using the Service. If you cancel, cancellation takes effect at the end of the current billing period and you will retain access until then; no partial or prorated refund is provided for the unused portion of the billing period. Refunds are issued only where required by applicable law (for example, under the statutory consumer withdrawal right where it applies and has not been waived). We reserve the right to change our fees upon reasonable notice.

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Service. You are solely responsible for all content generated, published, or distributed through your use of the Service, including AI-generated blog posts. You agree NOT to: • Use the Service for any illegal, harmful, fraudulent, infringing, or malicious purpose; • Generate, publish, or distribute content that is illegal, defamatory, harassing, hateful, discriminatory, sexually explicit, or that infringes upon intellectual property or privacy rights; • Use the Service to spread misinformation, spam, malware, phishing, or any form of deception; • Attempt to gain unauthorized access to, disrupt, or damage the Service, its systems, or any third-party systems; • Resell, sublicense, or redistribute the Service without our prior written consent; • Use the Service to manipulate search engine rankings through deceptive or prohibited techniques, including but not limited to content scraping, cloaking, or generating content intended solely to manipulate rankings without providing value to human readers; • Violate any applicable law, regulation, or third-party agreement, including the terms of any content management system or platform you connect to the Service. We reserve the right to investigate and take appropriate action, including suspending or terminating accounts and removing content, for any violation of these Terms.

We reserve the right to suspend, disable, or terminate your account and access to the Service at any time, with or without cause and with or without notice, in our sole discretion. Without limiting the foregoing, we may immediately remove, suspend, or terminate any account where we determine, in our sole discretion, that the account is being used for illegal, harmful, abusive, fraudulent, or otherwise prohibited activities, or where required to protect the integrity, security, or reputation of the Service or its users. Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination shall survive.

The Service generates content using artificial intelligence models. AI-generated content may contain inaccuracies, errors, or unsuitable material. You are solely responsible for reviewing, editing, and approving all content before publication. We do not guarantee that any content generated by the Service will be accurate, complete, suitable, or effective for any particular purpose, including achieving specific SEO rankings or search engine placement. You assume all risk and responsibility for the use and publication of any AI-generated content. Search engine algorithms are controlled by third parties and we cannot guarantee any specific ranking outcome.

The Service and its original content, features, and functionality are owned by Diamant Marketing and are protected by international copyright, trademark, and other intellectual property laws. Content you generate through the Service using your own inputs remains your responsibility and you retain ownership of such content. You retain ownership of your input data, while we retain ownership of the Service itself, including its software, algorithms, and infrastructure. Trademarks, logos, and service marks displayed on the Service are the property of Diamant Marketing or their respective owners.

The Service may integrate with third-party platforms, content management systems, and services (such as WordPress, Shopify, Wix, Webflow, Ghost, GoHighLevel, Notion, Joomla, Drupal, and others). Such integrations are subject to the terms and policies of those third parties. We are not responsible for the actions, availability, or policies of any third-party service. You are responsible for ensuring that your use of such integrations complies with all applicable terms. Some platforms may restrict or modify certain content elements (such as tracking scripts) published through the Service; we are not liable for such modifications.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any results, including SEO performance results, search engine rankings, traffic increases, or AI visibility improvements, will be achieved. Your use of the Service is at your sole risk.

To the fullest extent permitted by law, in no event shall Diamant Marketing, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of, or inability to use, the Service, whether based on warranty, contract, tort, or any other legal theory, and whether or not we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or relating to the Service shall not exceed the amount you have paid to us in the three (3) months preceding the claim.

You agree to defend, indemnify, and hold harmless Diamant Marketing and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any rights of a third party, including any claim arising from content you publish through the Service.

We reserve the right to modify these Terms at any time. We will notify users of material changes via the Service or other reasonable means. Your continued use of the Service after any changes take effect constitutes your acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to conflict of law principles. Any disputes arising under or in connection with these Terms shall be resolved through good-faith negotiations. Where unresolved, disputes shall be submitted to the exclusive jurisdiction of the competent courts of Malmö, Sweden. The consumer protection laws of your country of residence shall not be affected by this clause where mandatory under applicable law.
